Terms of Service

1. Acceptance of these terms

By creating an account or using mig99, you agree to be bound by these Terms. If you do not agree with them, please do not use the app.

2. Eligibility

You must be at least 18 years old to use mig99. By registering you confirm that you meet this requirement.

3. Your account

You are responsible for keeping your credentials secure, for everything that happens under your account, and for giving accurate information when you register. Do not share your account with anyone.

One person, one account. Creating accounts to evade a block, a ban, or a usage limit is a violation of these Terms.

4. Acceptable use

You agree not to:

• Post illegal, abusive, threatening, hateful, or harassing content.
• Post sexual content involving minors, or any content that sexualises a minor. This results in an immediate permanent ban and, where the law requires it, a report to the authorities.
• Impersonate another person, a public figure, or mig99 staff.
• Spam or flood rooms and private messages.
• Share another person's private information without their consent.
• Attempt to hack, scrape, reverse-engineer, overload, or otherwise disrupt the service.
• Use the service for advertising or commercial solicitation without our written permission.

5. Moderation and enforcement

There is zero tolerance for objectionable content and abusive users. Users can report and block other users from their profiles, in rooms and on stories, and room owners and moderators can remove people from their own rooms. We review reports within 24 hours, remove content that breaks these Terms, and ban the accounts that posted it.

Each violation a moderator confirms is recorded on the account: the first brings a warning, the second 24 hours without writing, the third a 7-day suspension and any further one a 90-day suspension. Severe violations lead to a permanent ban. A violation falls away after 180 days. Users can see their record in Settings > Privacy & safety > Account status and appeal from there.

We are not obliged to monitor everything posted, and we do not endorse what users say. Content posted by users is theirs, not ours.

6. Your content

You keep ownership of everything you post. By posting, you grant mig99 a non-exclusive, royalty-free licence to store, display and transmit that content for the sole purpose of operating the service — showing your message to the room you sent it to, your photo on your profile, and so on. This licence ends when you delete the content or your account, except for copies we are legally required to retain.

We do not sell your content, and we do not use it to train anything.

7. Points, items and gifts

mig99 has an optional in-app currency, points. You buy point packs through Google Play on Android or Apple's App Store on iPhone, which shows the price in your local currency before you confirm, and you spend points on items inside the app.

• All payments are handled by Google Play or the App Store. mig99 never receives your payment details.
• Points are a licence to use features of mig99. They are not money, have no cash value, cannot be exchanged for money, and cannot be transferred except by sending gifts inside the app.
• Monthly items (the verification badge, titles, bubble colours, room pinning and larger rooms) last 30 days. While auto-renew is on for an item, it renews from your point balance at the end of each period. You can turn auto-renew off at any time in My items; the item then stays active until its period ends. If your balance is too low when renewal is due, the item ends.
• Switching to a dearer title or size costs only the difference and keeps your period. Switching to a cheaper one is allowed once per period and does not refund the difference.
• When you send a gift, its points leave your balance, and the recipient receives half of them. Gifts cannot be cancelled.
• Sharing a story on the map costs points and makes it visible to everyone for 24 hours. Deleting it early does not return the points. Replying to a map story from someone who is not your friend opens a private chat for points, free with the same person for 24 hours; only the person replying pays.
• If you invite a friend with your link and they stay active for three days, you receive bonus points, up to two invites a month and one per device. Invite points are spent first on your own items and cannot be gifted. Bonus points obtained by abusing invites may be removed.
• Refunds of point packs are handled by Google Play or Apple, whichever store you bought from, under its refund policy. If a purchase is refunded, the points it added are removed from your balance.

8. Free limits

Free accounts have limits on some features — how many rooms you can create, how many people can join a room you own, and how many new people you can start private conversations with per day, among others. These limits exist to keep the service usable and to prevent spam. We may adjust them, and we will not reduce a limit you have already paid points to raise for the period you paid for.

9. Availability and changes

We may modify, suspend, or discontinue features at any time. For changes that materially affect you we will try to give notice in advance. We do not guarantee uninterrupted or error-free service.

10. Termination

You may delete your account at any time from Settings → Delete My Account.

We may suspend or terminate an account that violates these Terms. Where it is reasonable to do so we will tell you why. If we terminate your account without cause while you hold points you bought, we will refund the value of the purchased points you had not yet used.

11. Disclaimer and liability

mig99 is provided "as is", without warranties of any kind, to the fullest extent the law allows. We are not liable for indirect, incidental, or consequential damages arising from your use of the service, and our total liability shall not exceed the amount you paid us in the 12 months before the claim.

Nothing here limits liability that cannot lawfully be limited — including liability for death or personal injury caused by negligence, for fraud, or for your statutory rights as a consumer.

12. Governing law and disputes

These Terms are governed by applicable law. If you are a consumer in the EU, you keep the protection of the mandatory laws of your country of residence and may bring proceedings in your local courts. We will try to resolve any dispute through good-faith negotiation first.

١. قبول هذه الشروط

بإنشائك حساباً أو باستخدامك mig99، فأنت توافق على الالتزام بهذه الشروط. وإن لم توافق عليها، فالرجاء عدم استخدام التطبيق.

٢. الأهلية

يجب أن تكون في الثامنة عشرة من عمرك على الأقل لاستخدام mig99. وبتسجيلك تؤكّد أنك تستوفي هذا الشرط.

٣. حسابك

أنت مسؤول عن حفظ بيانات دخولك، وعن كل ما يجري تحت حسابك، وعن صحّة المعلومات التي تقدّمها عند التسجيل. ولا تشارك حسابك مع أحد.

شخص واحد، حساب واحد. وإنشاء حسابات للتحايل على حظر أو منع أو حدّ استخدام مخالفةٌ لهذه الشروط.

٤. الاستخدام المقبول

تلتزم بألّا:

• تنشر محتوى غير قانوني أو مسيء أو تهديدياً أو كارهاً أو متحرّشاً.
• تنشر محتوى جنسياً يتعلّق بقاصرين، أو أي محتوى يُجنسِن قاصراً. وعقوبة ذلك حظر دائم فوري، وإبلاغ الجهات المختصّة حيثما أوجب القانون.
• تنتحل شخصية غيرك أو شخصية عامة أو أحد العاملين في mig99.
• تُرسل رسائل مزعجة أو تُغرق الرومات والمحادثات الخاصة.
• تنشر معلومات خاصة بغيرك دون إذنه.
• تحاول اختراق الخدمة أو كشط بياناتها أو هندستها عكسياً أو إثقالها أو تعطيلها بأي صورة.
• تستخدم الخدمة للإعلان أو الترويج التجاري دون إذن كتابي منّا.

٥. الإشراف والتنفيذ

لا تسامح إطلاقاً مع المحتوى المرفوض أو المستخدمين المسيئين. يستطيع المستخدمون الإبلاغ عن بعضهم وحظرهم من الملف الشخصي وفي الرومات وعلى الحالات، ويستطيع مالك الروم والمشرفون إخراج الأشخاص من رومهم. ونراجع البلاغات خلال ٢٤ ساعة، ونحذف المحتوى المخالف لهذه الشروط، ونحظر الحسابات التي نشرته.

ولسنا ملزمين بمراقبة كل ما يُنشر، ولا نتبنّى ما يقوله المستخدمون. فما ينشره المستخدمون يخصّهم لا يخصّنا.

٦. المحتوى الخاص بك

تحتفظ بملكية كل ما تنشره. وبنشرك، تمنح mig99 ترخيصاً غير حصري وبلا مقابل لتخزين ذلك المحتوى وعرضه ونقله، لغرض تشغيل الخدمة وحده — أي إظهار رسالتك للروم الذي أرسلتها إليه، وصورتك في ملفك الشخصي، وما شابه. وينتهي هذا الترخيص بحذفك للمحتوى أو لحسابك، عدا النسخ التي يلزمنا القانون بحفظها.

ولا نبيع محتواك، ولا نستخدمه لتدريب أي شيء.

٧. النقاط والمقتنيات والهدايا

في mig99 عملة اختيارية داخل التطبيق هي النقاط. تشتري باقات النقاط عبر Google Play على أندرويد أو متجر App Store من Apple على الآيفون، ويعرض المتجر السعر بعملتك المحلّية قبل أن تؤكّد، وتنفق النقاط على مقتنيات داخل التطبيق.

• كل المدفوعات تُعالَج عبر Google Play أو App Store، وmig99 لا يتسلّم بيانات دفعك أبداً.
• النقاط ترخيص لاستخدام مزايا mig99، وليست مالاً: لا قيمة نقدية لها، ولا تُستبدل بمال، ولا تُحوَّل إلا بإرسال الهدايا داخل التطبيق.
• المقتنيات الشهرية (علامة التوثيق والألقاب وألوان الفقاعة وتثبيت الروم والسعة الأكبر) تدوم ٣٠ يوماً. وما دام التجديد التلقائي مفعّلاً لأحدها فإنه يتجدّد من رصيد نقاطك في نهاية كل فترة. ويمكنك إيقاف التجديد التلقائي في أي وقت من مقتنياتي، فيبقى المقتنى فعّالاً حتى تنتهي فترته. وإن لم يكفِ رصيدك عند موعد التجديد ينتهي.
• التبديل إلى لقب أو سعة أغلى يكلّف الفرق فقط ويُبقي فترتك، والتبديل إلى الأرخص مسموح مرة واحدة في كل فترة دون استرداد الفرق.
• عند إرسال هدية تُخصم نقاطها من رصيدك، ويحصل المُهدى إليه على نصفها. ولا يمكن إلغاء الهدية بعد إرسالها.
• نشر حالة على الخريطة يكلّف نقاطاً ويجعلها مرئية للجميع لمدة ٢٤ ساعة، وحذفها مبكراً لا يعيد النقاط. والرد على حالة خريطة من غير أصدقائك يفتح محادثة خاصة مقابل نقاط، ومجاناً مع نفس الشخص خلال ٢٤ ساعة، ويدفع الشخص الذي يرد فقط.
• إن دعوت صديقاً برابطك وبقي نشطاً ثلاثة أيام تحصل على نقاط مكافأة، بحدّ أقصى دعوتان في الشهر ودعوة واحدة لكل جهاز. وتُنفق نقاط الدعوات أولاً على مقتنياتك ولا يمكن إهداؤها. ولنا إزالة نقاط المكافأة التي تُكسب بإساءة استخدام الدعوات.
• استرداد مبالغ باقات النقاط تعالجه Google Play أو Apple، بحسب المتجر الذي اشتريت منه، وفق سياسة الاسترداد الخاصة به. وإن استُردّ مبلغ شراء أُزيلت النقاط التي أضافها من رصيدك.

٨. حدود الحساب المجاني

للحسابات المجانية حدود على بعض المزايا — عدد الرومات التي تنشئها، وعدد من ينضمّ إلى رومك، وعدد الأشخاص الجدد الذين تبدأ معهم محادثات خاصة يومياً، وغير ذلك. وهذه الحدود موجودة لإبقاء الخدمة صالحة للاستخدام ولمنع الإزعاج. ولنا أن نعدّلها، ولن نخفض حدّاً دفعتَ نقاطاً لرفعه خلال الفترة التي دفعت ثمنها.

٩. التوافر والتعديلات

لنا أن نعدّل المزايا أو نوقفها أو نلغيها في أي وقت. وسنحاول الإشعار مسبقاً بالتغييرات التي تمسّك جوهرياً. ولا نضمن خدمة متواصلة أو خالية من الأخطاء.

١٠. إنهاء الحساب

يمكنك حذف حسابك في أي وقت من الإعدادات ← حذف حسابي.

ولنا أن نوقف أو نُنهي حساباً يخالف هذه الشروط، وسنخبرك بالسبب حيثما كان ذلك معقولاً. وإن أنهينا حسابك بلا سبب وفي رصيدك نقاط اشتريتها، فسنردّ لك قيمة النقاط المشتراة التي لم تستخدمها.

١١. إخلاء المسؤولية وحدودها

يُقدَّم mig99 «كما هو» دون ضمانات من أي نوع، إلى أقصى حدّ يسمح به القانون. ولا نتحمّل مسؤولية الأضرار غير المباشرة أو العرضية أو التبعية الناشئة عن استخدامك للخدمة، ولا تتجاوز مسؤوليتنا الإجمالية ما دفعته لنا خلال الاثني عشر شهراً السابقة للمطالبة.

ولا شيء هنا يحدّ من مسؤولية لا يجوز قانوناً الحدّ منها — بما فيها المسؤولية عن الوفاة أو الإصابة الشخصية الناتجة عن الإهمال، أو عن الاحتيال، أو عن حقوقك القانونية كمستهلك.

١٢. القانون الحاكم والنزاعات

تخضع هذه الشروط للقانون المعمول به. وإن كنت مستهلكاً في الاتحاد الأوروبي، فتبقى لك حماية القوانين الآمرة في بلد إقامتك، ويمكنك رفع الدعوى أمام محاكمك المحلّية. وسنحاول حلّ أي نزاع بالتفاوض بحسن نية أولاً.
